Mandates expulsion for not less than one year for students who initiate nonconsensual sexual activity, sexual assault, or attempted sexual assault at school, school-sponsored events, or school-related activities.

Defines covered offenses as: using force or threat of force to make another perform a nonconsensual sexual act; committing sexual penetration using force or threat of force; or taking substantial steps toward committing sexual assault with intent.

Allows the superintendent to modify the one-year minimum expulsion requirement on a case-by-case basis, with the school board able to further modify the superintendent's determination.

Requires expulsion decisions to be construed consistently with the federal Individuals with Disabilities Education Act, and permits expelled students to be eligible for transfer to an alternative school program.

Amends the School Code (105 ILCS 5/10-22.6) and takes effect immediately upon becoming law.
