Health insurers must automatically suppress "sensitive health care information" from explanation of benefits, payment summaries, claims histories, and other communications sent to policy subscribers about services received by other covered family members.

Insured members can opt out of this automatic suppression by making an oral or written request to have their sensitive health information shared on documents sent to the subscriber.

The Department of Insurance receives rulemaking authority and must collaborate with the Department of Public Health to develop an education plan for providers and consumers about these confidentiality rights.

Requirements apply across multiple insurance types including state employee group insurance, county and municipal self-insured plans, school district plans, HMOs, limited health service organizations, voluntary health service plans, and Medicaid.

Effective one year after becoming law.
