Data brokers operating in Illinois must register annually with the Attorney General by January 31 and pay a registration fee

"Data broker" is defined as a business that knowingly collects and sells personal information of consumers to third parties without having a direct relationship with those consumers

Registration requires disclosure of company contact information, whether the broker collects data on minors, precise geolocation, or reproductive health care data, and applicable federal regulatory coverage

Entities covered by the federal Fair Credit Reporting Act or Gramm-Leach-Bliley Act are exempt from the data broker definition

Civil penalties of $200 per day apply for failure to register, plus unpaid fees and Attorney General investigation costs, with all funds deposited into a new Data Broker Registry Fund
