Creates the new offense of criminal damage to property at critical infrastructure facilities, with penalties ranging from Class 4 felony (damage up to $500) to Class 2 felony (damage exceeding $10,000)

Renames "criminal trespass to a nuclear facility" as "criminal trespass to a critical infrastructure facility" and adds a required element that the person must intend to damage, destroy, or tamper with equipment

Defines critical infrastructure facilities to include petroleum refineries, electrical power facilities, water treatment plants, telecommunications infrastructure, pipelines, railroads, chemical plants, dams, mines, and manufacturing facilities (must be enclosed by fence or barrier)

Establishes civil liability allowing facility owners to recover money damages, court costs, and attorney's fees from violators

Exempts lawful labor activities including union organizing, picketing arising from labor disputes, workplace safety monitoring, and exercises of free speech or assembly rights
