Adds "summary of performance" for students who received special education services to the definition of "Student Permanent Record" under the Illinois School Student Records Act, with the format to be substantially similar to the State Board of Education's developed form

Requires summaries of performance to be kept confidential and prohibits disclosure except to parents/students or to the Department of Human Services for Medicaid waiver eligibility assessments

Allows exclusion of the summary of performance from permanent records only if parents/guardians and students provide written consent after being notified that school districts do not keep special education records beyond 5 years and that lacking this documentation may affect eligibility for future state or federal benefits

Authorizes release of student records to the Department of Human Services solely for assessing or evaluating a student's eligibility for Medicaid waiver benefits, consistent with department rules

Takes effect July 1, 2026
