Individual and group health insurance policies amended, delivered, issued, or renewed in Illinois after June 1, 2026 must cover standard fertility preservation services, including cryopreservation and related follow-up services such as storage

"Standard fertility preservation services" are defined as procedures based on evidence-based standards of care established by the American Society for Reproductive Medicine, the American Society of Clinical Oncology, or other national medical associations

Insurers are prohibited from discriminating in coverage decisions based on an individual's expected length of life, disability, quality of life, age, sex, sexual orientation, or marital status

Policies cannot impose exclusions, limitations, deductibles, copayments, or waiting periods on fertility preservation services that differ from those applied to other prescription medications or non-fertility-related services

The requirement extends to state employee health plans, county and municipal self-insured plans, school district employee insurance, health maintenance organizations, limited health service organizations, and the Medicaid program through conforming amendments to multiple Illinois statutes
