Counties and municipalities may use utility poles and public rights-of-way owned by the State or other local governments to place public safety equipment

Equipment must not be located within or interfere with electric distribution/transmission systems, communication worker safety zones, or electric supply zones as defined by the National Electric Safety Code

State agencies may create permitting processes by rule, and local governments may do so by ordinance or resolution, to regulate this use of their utility poles and rights-of-way

Fees charged for such use must be at the lowest rate charged by the owner and cannot exceed the owner's actual costs

The law does not authorize counties or municipalities to use property or infrastructure owned by private public utilities
