IL SB1701

Amends the Illinois Public Labor Relations Act to classify undersheriffs, chief deputies filling vacancies under Section 3-3010 of the Counties Code, and jail superintendents as "managerial employees," excluding them from collective bargaining units unless the sheriff and union agree otherwise or they are already recognized under existing provisions

Establishes that for non-State Police officers, "supervisor" includes any officer in a permanent appointed rank (not subject to promotional testing) and the rank immediately below Chief, unless that rank is patrol officer

Creates an exception allowing employers to designate a Shift Commander position as supervisory when no rank exists between chief and the highest company officer

Excludes from the "supervisor" definition police officers covered by collective bargaining agreements, those in tested ranks under Division 1 or 2.1 of the Illinois Municipal Code, or those in positions historically or voluntarily recognized as covered by bargaining agreements

Takes effect July 1, 2026
