IL SB1799

Amends the School Code to define "emergency situation" for third-party non-instructional service contracts as a sudden, unforeseen event that would cause near-term interruption of services requiring immediate action

Requires school boards entering emergency contracts (maximum 3 months) with third parties for non-instructional services to post all vacant positions on the district website, job portals, databases, and social media for the duration of the contract

After attempting to renew or enter a second emergency contract for the same group of employees, school boards must either hold a public hearing or obtain mutual agreement with the affected bargaining unit

After attempting a third or subsequent emergency contract for the same employee group, school boards are required to obtain mutual agreement with the affected bargaining unit

Mutual agreements must include development of a recruitment and retention plan addressing timelines, rationale for third-party use, job descriptions, advertising plans, pay, benefits, and incentives; these agreements cannot be used to compel reopening collective bargaining agreements
