IL SB1939

Amends the Motor Vehicle Franchise Act to add a new definition of "common entity" covering persons directly or indirectly controlled by or sharing common management with a manufacturer, importer, or distributor

Prohibits manufacturers from directly or indirectly competing with their franchisees in the sale, lease, or warranty service of new motor vehicles, and bars manufacturers from using common entities, affiliates, or spin-off companies to sell vehicles directly to consumers or bypass franchise dealer networks

Prevents manufacturers or distributors not lawfully licensed to sell directly to consumers before January 1, 2022 from owning or operating dealerships or selling new vehicles directly to the public in Illinois

Clarifies warranty reimbursement standards, specifying that dealers' prevailing retail price for parts must be compared to holders of franchises of the same line make (rather than same manufacturer) in the geographic area

Defines "routine maintenance" excluded from average percentage markup calculations to include oil/fluid changes, filters, batteries, brake pads, tires, wheel alignments, and accessory installations
