Requires all municipalities and counties in Illinois to adopt regulations by January 1, 2026 governing the retail sale of nicotine-containing products near schools and day care centers

If local governments fail to adopt their own regulations by the deadline, the Department of Revenue is prohibited from issuing new licenses for nicotine product sales within 1,000 feet of schools or day care centers in those jurisdictions

Existing retailers operating before January 1, 2026 may keep or renew their licenses unless the school principal or day care center owner within 1,000 feet submits written opposition to the Department of Revenue

Preempts home rule authority, preventing local governments from regulating nicotine sales near schools in ways inconsistent with the Act

Takes effect immediately upon becoming law
