IL SB3148

Prohibits distributors, secondary distributors, retailers, and their agents from selling, offering for sale, or possessing with intent to sell any flavored tobacco products, flavored alternative nicotine products, or flavored e-cigarette solutions in Illinois, effective June 1, 2026.

Defines "characterizing flavor" broadly to include any distinguishable taste or aroma other than tobacco, such as fruit, chocolate, vanilla, honey, candy, mint, menthol, wintergreen, herbs, or spices.

Creates a rebuttable presumption that a product is flavored if it has a characterizing flavor or if manufacturer marketing, packaging text, colors, or images suggest a flavor.

Allows distributors to temporarily possess and store flavored products acquired outside Illinois only if those products are subsequently shipped out of state.

Establishes license suspension penalties enforced by the Department of Human Services: 3 days for first violation, 7 days for second violation, and 30 days for third and subsequent violations.
