Manufacturers must register all electronic cigarette products with the Illinois Department of Revenue and submit a sworn affidavit before selling in the state.

The affidavit must attest that the manufacturer has either applied for or received FDA premarket authorization for the electronic cigarette product.

Manufacturers must notify the Department of Revenue within 30 days of any material changes, including FDA decisions to deny authorization or order product removal from the market.

The Department of Revenue must maintain a publicly available online registry of registered products, updated daily.

Non-compliant electronic cigarette products may be seized by the Department of Revenue, Department of Public Health, Attorney General, or local law enforcement, and manufacturers who violate these requirements face Class A misdemeanor charges.
