IL SB3458

Creates a new offense of "unlawful restraint for civil immigration enforcement" under the Criminal Code of 2012, targeting individuals who knowingly detain, forcibly transfer, or use deceit to move another person for civil immigration purposes without express legal authority from a federal immigration agent.

Defines prohibited conduct to include: detaining someone for civil immigration enforcement, using force or threats to transfer someone, using deceit or enticement to induce transfer, or using a deadly weapon during such detention or transfer.

Classifies violations as a Class 4 felony, elevated to a Class 3 felony when a deadly weapon is used during the offense.

Exempts federal immigration agents (ICE, Customs and Border Protection, or similar agencies) from the offense, and excludes actions related to federal criminal charges or criminal warrants from the definition of "civil immigration enforcement."
