IL SB3551

Creates the Government Communications Transparency and Security Act, prohibiting government entities, officers, and employees from using end-to-end encryption platforms with autodeletion features (such as disappearing messages or timed deletion) on government communication devices.

Requires internet service providers, telecommunications carriers, app marketplaces, and digital platforms doing business in Illinois to block access to and prevent installation of encryption platforms with autodeletion on government devices.

Establishes that knowing violations by government officers or employees constitute official misconduct under the Criminal Code; tech companies face civil penalties of at least $50,000 per violation.

Authorizes the Attorney General or any Illinois taxpayer to bring civil actions to enforce the Act, with prevailing parties entitled to recover attorney's fees and costs.

Effective January 1, 2027, with the Department of Innovation and Technology responsible for adopting implementation rules.
