Counties cannot approve siting of commercial wind, solar, or energy storage facilities in unincorporated areas within a 3-mile radius of a municipality if: the municipality has not approved the siting, the land has a Soil Productivity Index of 90 or greater, or the facility operators have failed to comply with NPDES requirements.

Commercial solar energy facilities must have the minimum number of fire hydrants required by the servicing fire department, fire protection district, or county board ordinances.

Counties may require commercial solar energy facilities to maintain a 500-foot setback from property lines of nonparticipating zoned residential properties.

Counties must require energy storage systems to be sited at least 500 feet from property lines of nonparticipating zoned residential properties.

Effective date is January 1, 2027, and amends Sections 5-12020 and 5-12024 of the Counties Code (55 ILCS 5).
