Every Illinois county and municipality must establish a resident reporting process by January 1, 2027, allowing people to report businesses suspected of unlawfully manufacturing or delivering nitrous oxide for inhalation purposes.

Counties and municipalities must adopt regulations by January 1, 2027, to prevent businesses, including retail tobacco stores, from selling nitrous oxide intended for inhalation to cause intoxication, euphoria, or altered mental states.

Regulations must specify how local governments will address businesses once they have actual knowledge of violations under Section 24.5-10 of the Criminal Code of 2012.

Home rule powers are limited, prohibiting counties and municipalities from regulating nitrous oxide retail sales in ways inconsistent with the new requirements.

The bill amends both the Counties Code (55 ILCS 5) and the Illinois Municipal Code (65 ILCS 5) and takes effect immediately upon becoming law.
