Licensed professionals regulated by the Department of Financial and Professional Regulation must prominently disclose when paying customers are interacting with artificial intelligence, including verbal disclosure at the start of oral conversations and written disclosure before written exchanges

Disclosures must notify the person of the specific purpose of the AI being used in the interaction

Violations carry civil penalties up to $2,500 per violation, assessed based on degree of harm and circumstances, with payment required within 60 days of a Department order

Amends the Consumer Fraud and Deceptive Business Practices Act to make it unlawful for any business to use AI in trade and commerce without disclosing AI use when asked by the person interacting with it

Effective January 1, 2027, with the Department of Financial and Professional Regulation granted rulemaking authority to administer and enforce the Act
