Amends the Illinois Human Rights Act to require the Department of Human Rights to issue a Departmental right to sue notice when the EEOC issues a right to sue, rather than adopting the EEOC determination as a dismissal for lack of substantial evidence

Complainants have 35 days after receiving the Department's notice to request a review of the EEOC's determination; if no request is filed, the Department must issue a right to sue notice within 10 business days

Requires the Department to notify complainants within 10 days of filing about their right to opt out of investigation within 60 days to commence circuit court action, and their right to request a Departmental right to sue after 60 days

Establishes that a Departmental right to sue notice does not constitute a finding of substantial evidence or lack thereof

Complainants receiving a right to sue notice have 90 days to either file a complaint with the Human Rights Commission or commence a civil action in circuit court
