Creates a new cause of action against any person who, acting under color of state law or local ordinance, deprives citizens of rights secured by the Illinois Constitution.

Eliminates qualified immunity defenses, including good faith belief, reasonable belief conduct was lawful, rights not being "clearly established," and acting in prosecutorial or judicial capacity.

Requires prevailing plaintiffs to receive attorney's fees and litigation costs, including hourly, contingency, and pro bono fees.

Defines "prevailing" broadly to include obtaining relief through judgment, settlement, or the defendant's voluntary action in response to the lawsuit.

Designates the Act as the "Abraham Lincoln Law" and specifies it controls over any conflicting state laws.
