Broadband grant recipients with proper highway right-of-way permits may install, maintain, and use broadband infrastructure along highway rights-of-way without property owners being able to forbid access.

Property owners within highway rights-of-way must be notified 14-60 days before broadband deployment via certified mail or personal service, with detailed construction plans and project timelines.

Property owners have 45 days after the anticipated deployment date to demand just compensation for diminished property value; failure to provide timely notice bars compensation claims.

Broadband grant recipients must indemnify property owners for physical damage caused by deployment, and property owners are absolved of liability for infrastructure damage during normal property use including farming.

The rights and obligations established under this Act sunset on January 1, 2030.
