Municipalities and counties may conduct tank removal, abandonment, site investigation, and corrective action for petroleum orphan underground storage tanks under the Leaking Underground Storage Tank Program

"Orphan underground storage tank" is defined as an underground storage tank that does not have an owner or operator subject to the requirements of the Petroleum Underground Storage Tanks Title

Local governments are not required to elect to proceed as an owner to take action on orphan tanks, unlike the standard process for other entities

Costs incurred by municipalities or counties for orphan tank cleanup are eligible for payment from the Underground Storage Tank Fund without tank registration, fees, eligibility determination, or deductible requirements

Amends Sections 57.1, 57.2, and 57.11 of the Environmental Protection Act (415 ILCS 5)
