HB 1010 Summary

• Prohibits public works contract plans, specifications, and documents from requiring bidders, contractors, or subcontractors to enter into or comply with labor organization agreements effective July 1, 2010.

• Bars discrimination against bidders, contractors, or subcontractors who refuse to enter into, remain signatory to, or comply with labor organization agreements on public works projects.

• Prohibits contract requirements that condition employment on becoming a labor organization member or paying dues/fees exceeding an employee's share of collective bargaining, contract administration, or grievance adjustment costs.

• Creates a cause of action for interested parties (bidders, contractors, subcontractors, employees, and taxpayers) to challenge contract awards violating these provisions, with prevailing parties entitled to attorney's fees, costs, and declarations voiding violating provisions.

• Applies restrictions to contracts awarded by public agencies, departments, and local authorities while preserving rights and activities protected under the federal National Labor Relations Act.
