HB 1033 Summary

• Requires motor vehicle operators to display lighted headlamps and illuminating devices whenever weather conditions require continuous operation of windshield wipers, effective July 1, 2010.

• Violation of the windshield wiper headlight requirement is classified as a Class D infraction rather than the standard Class C infraction for other lighting violations.

• Bureau of Motor Vehicles may not assess points under the point system for windshield wiper-related headlight violations, and such violations cannot be used in habitual violator status determinations.

• Prohibits law enforcement from stopping, inspecting, or detaining a vehicle solely based on failure to display headlamps when windshield wipers are operating.
