House Bill 1038 Summary

• Expands pre-adoptive sibling information requests to apply to all adoptions, removing the previous limitation to adoptions filed after December 31, 1993.

• Allows adoptees and pre-adoptive siblings age 21+ to submit written requests to the state registrar expressing interest in reunion and authorizing release of their name and location.

• Requires the state registrar to search sealed adoption records and contact pre-adoptive siblings to determine whether they consent to information release.

• Permits adoptive parents of children under 21 to request pre-adoptive sibling information, with release determined by the same consent procedures as for adults.

• Creates new Chapter 31-19-25.5 establishing the framework for requests, consent procedures, fee structures, and state registrar authority to implement pre-adoptive sibling information exchanges; effective July 1, 2010.
