House Bill 1080 Summary

• IDEM may not require a county to establish or join a regional sewage district for unincorporated areas unless population density exceeds a minimum threshold established by county ordinance.

• County legislative bodies must adopt an ordinance in consultation with local health departments establishing minimum population density requirements for septic system discontinuation in unincorporated areas.

• Property owners in unincorporated areas with functioning septic systems (as certified by local health department) cannot be required to connect to regional sewer districts.

• Property owners in incorporated areas may qualify for a 3-year exemption from sewer connection if their septic system was installed within 5 years before the district's anticipated connection date and is functioning satisfactorily.

• Effective July 1, 2010.
