HB 1131 Summary

• Prohibits smoking in public places, enclosed areas of employment, and state vehicles used for governmental functions, effective July 1, 2010.

• Allows smoking exceptions for horse racing facilities, riverboats, gambling facilities, satellite facilities, age-restricted bars and clubs, tobacco businesses, nonprofits, and family-owned businesses with no public access.

• Requires owners and managers to post "Smoking Is Prohibited By State Law" signs, remove ashtrays from prohibited areas, and request or remove violators from smoking areas.

• Makes smoking violations a Class B infraction, escalating to Class A infraction if the person has three or more prior unrelated violations.

• Permits counties, cities, towns, and other governmental units to adopt more restrictive smoking ordinances, except for gambling and racing facilities unless specifically included.
