HB 1137 Summary

• Establishes a statewide recall procedure for elected state, legislative, local, and school board officials (excluding justices, judges, and prosecuting attorneys) and appointed state or political subdivision officials.

• Requires recall petitions to be signed by at least 10% of registered voters in the jurisdiction, or for statewide officials, 10% of total votes cast in the last secretary of state election with minimum 1% from each of five different counties and no more than 50% from any single county.

• Removes an official from office if either 60% of votes cast or a majority of registered voters in the election district vote affirmatively on the recall question.

• Sets filing deadlines of 120 days before a primary election or June 30 before a general/municipal election, with certification decisions required within 30 days.

• Prevents an official removed by recall from filling the vacancy created and prohibits another recall election against the same official for 12 months if the initial recall vote fails.
