HB 1144 Summary

• Restricts bail options for defendants charged with felonies under IC 35-42 (offenses against the person) to require full bail bonds with sureties, cash/securities deposits equal to full bail amount, real estate bonds, or combinations thereof.

• Prohibits defendants charged with felonies under IC 35-42 from using the 10% cash deposit bail option available to other defendants.

• Allows courts to impose additional conditions on bail for felony offenses against the person, including restrictions on activities, contact with victims, supervision requirements, and personal recognizance release restrictions.

• Requires remaining bail deposits to be remitted to defendants within 30 days after case disposition, with unremitted portions deposited into the supplemental public defender services fund.

• Effective July 1, 2010.
