House Bill 1152 Summary

• Allows out-of-state accident and sickness insurers licensed in accredited states to issue individual health insurance policies to Indiana residents without obtaining an Indiana certificate of authority

• Out-of-state insurers must comply with this chapter and the laws of their home state, but are exempt from other Indiana insurance regulations

• Insurance Commissioner may conduct market conduct and solvency examinations of out-of-state insurers and adopt rules to review and limit premium rate changes on these policies

• Out-of-state insurers must provide two bold-type notices to policyholders at issuance and renewal disclosing that policies are governed by home state law, may have higher premium increases than Indiana policies, and may exclude Indiana-mandated health benefits

• Effective July 1, 2010
