HB 1202 Summary

• Amends IC 34-31-9 to establish limited liability protections for school corporations, employees, volunteers, and independent contractors regarding school bus safety belt use.

• School corporations and their agents are not liable for passenger injuries or death if the passenger was required to wear a safety belt, instructed on proper use, but failed to wear it or wore it improperly.

• School corporations and their agents are not liable for passenger injuries or death if the passenger was not required to wear a safety belt but wore it improperly.

• Applies only to school buses equipped with safety belts that are operated by or on behalf of local public school corporations or charter schools.

• Effective July 1, 2010.
