HB 1207 Summary

• Amends IC 32-31-4 to regulate storage of tenant property after eviction, effective July 1, 2010.

• Storage facilities cannot release non-exempt tenant property without a written release from the landlord, and landlords must provide this release once the tenant reimburses all storage expenses paid by the landlord.

• Landlords are prohibited from withholding release of property based on other lease-related claims against the tenant.

• Expands the definition of "storage facility" to include warehousemen.

• Storage facilities retain a lien on non-exempt property for storage, transportation, insurance, labor, and preservation expenses, which tenants must pay (or reimburse the landlord for) to reclaim property within 90 days before the facility may sell the property.
