HB 1211 Summary

• Adds a public question to the 2010 general election ballot allowing voters to decide whether to dissolve certain fire protection territories established after December 31, 2007.

• Applies only to fire protection territories consisting of a municipality and some or all of its township, where one or more municipal employees serve on the legislative body of a participating unit.

• Requires the Department of Local Government Finance to identify qualifying fire protection territories and certify them to county election boards; the fire protection territory pays all costs of placing the question on the ballot.

• Dissolves the fire protection territory effective January 1, 2011 if a majority of voters approve, and prohibits the municipality and township from establishing a new fire protection territory.

• Declares an emergency for the act, making it effective upon passage.
