• Imposes an enhanced prepaid wireless charge on retail transactions of prepaid wireless telecommunications service, effective July 1, 2010.

• The wireless enhanced 911 advisory board determines the charge amount, which cannot exceed one-half of the monthly wireless emergency enhanced 911 fee assessed to standard subscribers.

• Sellers must collect the charge at point of sale, disclose it to consumers, and remit it to the department of state revenue for deposit in the wireless emergency telephone system fund.

• Sellers may retain 3% of collected charges as compensation, and the department may retain up to 2% to cover administrative costs.

• Charge is excluded from tax bases and sellers receive liability protections related to 911 service provision and law enforcement assistance.
