IN HB1220

Creates new offense of "permitting a minor to possess alcohol" for property owners or controllers who knowingly allow minors to possess or consume alcoholic beverages on their property

Establishes tiered penalties: Class B misdemeanor for first offense, Class A misdemeanor for repeat offenders with prior convictions under this section, and Class D felony if alcohol consumption proximately causes serious bodily injury or death

Exempts postsecondary educational institutions (universities, colleges, vocational schools, business schools, continuing education schools) from liability unless the institution directly provides alcohol to the minor

Effective date: July 1, 2010
