HB 1238 Summary

• Requires state educational institutions to disclose gifts exceeding $100,000 from foreign governments, foreign legal entities, or foreign persons within 30 days of the fiscal year end.

• Mandates disclosure of gift amount, date, conditions, restrictions, purpose, and identification of the foreign source (government name, country of entity location, or country of donor residence).

• Requires disclosure of foreign legal entity names if gifts contain conditions affecting curriculum control, faculty employment, student admission, student fees, or require the institution to take specific public positions or award honorary degrees.

• Applies to all state educational institutions, Ivy Tech Community College, and Vincennes University with disclosed information filed electronically to the Commission for Higher Education and Education Roundtable.

• Requires disclosed information remain on public websites for five years; effective July 1, 2010.
