House Bill 1262 Summary

• Defines "waste" for drug utilization review purposes in Medicaid to include inappropriate, overprescribing, underprescribing, overutilization, underutilization, or substantial noncompliant use of prescription drugs.

• Authorizes the office of Medicaid policy and planning to restrict mental health drugs prescribed to individuals under 18 years of age upon recommendation from the mental health Medicaid quality advisory committee and drug utilization review board.

• Restrictions on mental health drugs for minors do not apply if the drug is FDA-approved for individuals under 18 years of age or supported by a drug use review program under federal law.

• Effective date: July 1, 2010.
