HB 1278 Summary

• Imposes a direct broadcast satellite service fee on providers at the same percentage rate as local cable service franchise fees in effect on December 31, 2009, effective January 1, 2011.

• Requires direct broadcast satellite service providers to remit quarterly fees to the Department of State Revenue and submit quarterly reports detailing gross revenue and fees by local unit, with distributions made quarterly to each unit.

• Increases the wireless enhanced 911 fee to a minimum of $2 per month per commercial mobile radio service subscriber with a place of primary use in Indiana, effective July 1, 2010.

• Allocates wireless enhanced 911 fee distributions with 25% going to counties with more than two public safety answering points (PSAPs) and 75% to counties that have reduced PSAPs to no more than two.

• Allows direct broadcast satellite service fees to be passed through to customers and permits providers to identify the fee as a separate line item on customer bills.
