HB 1338 Summary

• Amends Indiana Code IC 35-48-4-1.1 to enhance penalties for methamphetamine manufacturing and related offenses.

• Elevates manufacturing methamphetamine to a Class A felony (from Class B) when the laboratory, chemicals, or waste from manufacturing causes serious bodily injury or death to any person other than the defendant.

• Maintains existing Class A felony provisions for methamphetamine dealing involving 3+ grams, delivery to minors, or activities near schools, parks, housing complexes, or youth centers.

• Effective July 1, 2010, applying only to crimes committed after June 30, 2010.
