HB 1345 Summary

• Requires written parental or guardian permission before spray tanning can be applied to a minor (person under 18 years of age)

• Mandates that a parent or guardian must be physically present at the spray tanning facility when a minor has exposed genitals, pubic area, buttocks, or breasts during the procedure

• Requires the spray tanning operator to be the same gender as the minor when applying spray tanning to exposed sensitive areas listed above

• Establishes penalties of a Class C infraction for first violations and Class B infraction for second or subsequent violations by spray tanning facility owners or operators

• Effective date: July 1, 2010
