• Establishes nonprofit or faith based community transition programs as eligible to receive nonviolent offenders for community reentry, with programs requiring written department approval and execution of an agreement before placements.

• Sets nonprofit or faith based community transition program commencement date at 100 days before an offender's expected release (versus 60-180 days for traditional programs) and limits eligibility to nonviolent offenders with sentences of at least 1.5 years.

• Requires department to reimburse nonprofit or faith based community transition programs on a per diem basis, with the rate set by the department but not less than 50% of the average daily cost of incarceration.

• Designates volunteers and employees of nonprofit or faith based community transition programs as public employees for tort immunity and liability purposes, and provides immunity to organizations operating such programs.

• Applies effective July 1, 2010, and amends multiple Indiana Code sections governing corrections, community transition programs, and governmental immunity.
