Senate Bill No. 109 Summary

• Indiana Department of Transportation must provide written notice to county executives, municipal executives, fire protection providers, and local emergency management directors before letting contracts for state highway construction or improvement projects requiring closure for at least 5 consecutive days.

• Governmental bodies receiving notice may submit written objections to the proposed project within 30 days of notification, stating their reasons for opposition.

• Department must respond to any objections received at a regularly scheduled meeting of the county board of commissioners, county fiscal body, or appropriate municipal fiscal body.

• Department may alter proposed projects to mitigate closure effects, but department decisions are final and not subject to judicial review.

• Effective date: July 1, 2010.
