SB 119 Summary

• Extends Sunday alcoholic beverage sales hours for retailer permit holders from 10 a.m.-12:30 a.m. to 7 a.m.-3 a.m. the following day, effective upon passage.

• Makes it a Class B misdemeanor for permittees or their employees to sell alcoholic beverages for carryout without first requiring proof of age (driver's license, government-issued ID card with photo, or government-issued photo document) showing the person is at least 21 years old.

• Provides a defense in criminal or administrative proceedings if the purchaser appeared to be more than 50 years of age.

• Requires permittees selling alcohol for carryout to post a visible sign at least 8.5 by 11 inches stating "STATE LAW REQUIRES IDENTIFICATION FOR SALES OF ALCOHOLIC BEVERAGES FOR CARRYOUT" in at least 20-point type.

• Adds government-issued photo documents as acceptable proof of age in defense against charges of furnishing alcohol to minors, effective July 1, 2010.
