Senate Bill No. 124 Summary

• Amends IC 35-41-3-1 to establish that parents or guardians have legal authority to apply reasonable force to or impose reasonable confinement on a child for proper control, training, or education.

• Establishes seven non-exhaustive factors to determine whether force or confinement is reasonable: child's age, sex, physical and mental condition, nature and motive of misbehavior, influence on other children, necessity to compel obedience to proper commands, and whether the action is disproportionate, degrading, or likely to cause serious or permanent harm.

• Effective July 1, 2010.
