Senate Bill No. 154 Summary

• Changes custody designation from "sole legal custody" to "primary physical custody" for mothers when a paternity affidavit is executed, unless a court determines otherwise.

• Grants the acknowledged father "parenting time in accordance with the parenting time guidelines adopted by the Indiana supreme court" upon execution of a paternity affidavit.

• Allows the father to request a genetic test within 60 days of the affidavit execution and permits rescission of the affidavit only if fraud, duress, or material mistake of fact is proven and genetic testing excludes him as the father.

• Requires hospitals and birthing facilities to provide the mother and alleged father an opportunity to execute a paternity affidavit and to verbally explain its legal effects before or immediately after birth.

• Effective date: July 1, 2010.
