Senate Bill 167 Summary

• Increases the penalty for purchasing drugs containing more than 3 grams of ephedrine or pseudoephedrine in one week from a Class C misdemeanor to a Class A misdemeanor.

• Maintains the existing Class C misdemeanor penalty for other violations of ephedrine/pseudoephedrine regulations, with enhancement to Class A misdemeanor only for prior unrelated convictions.

• Creates a specific Class A misdemeanor offense for violating the weekly purchase limit in subsection (d).

• Removes the requirement for the state police department to submit a report to the legislative council by June 30, 2007, on the effectiveness of ephedrine regulations.

• Takes effect July 1, 2010.
