SB 177 Summary

• Reduces term length for Indianapolis Historic Preservation Commission (IHPC) members appointed after December 31, 2010, from four years to two years.

• Allows property owners to appeal IHPC decisions on certificate of appropriateness applications to the Metropolitan Development Commission (MDC) on grounds of adverse property rights impacts, deprivation of reasonable property use, or hardship including infeasible or cost-prohibitive recommendations.

• Authorizes IHPC to grant certificates of authorization when denial would result in adverse effects on property rights, loss of reasonable use, or substantial hardship on the property owner.

• Establishes right to file petitions for certiorari to circuit or superior court to appeal IHPC or MDC decisions regarding certificate of appropriateness.

• Creates interim study committee with 12 legislative members to study IHPC and historic preservation commissions in other Indiana jurisdictions, with final report due before November 1, 2010.
