Senate Bill 191 Summary

• Waivers or releases of the right to remonstrate against annexation executed after June 30, 2010, expire ten years after the date of execution.

• Applies to waivers granted by service receivers in unincorporated areas under IC 13-18-15-2 (utility service connections).

• Applies to releases required as part of sewage works contracts under IC 36-9-22-2, with the ten-year expiration applying to both original contract parties and persons who subsequently tap into the sewage works.

• Provides an exception for landowners forced to connect to sewage works due to pollution or contamination caused by others, if connection costs are paid by someone other than the landowner or municipality.

• Effective July 1, 2010.
