Senate Bill 206 - Summary

• Increases penalties for employers who violate Indiana's common construction wage law or minimum wage law when the employee is an illegal alien, elevating violations from Class B misdemeanor to Class A misdemeanor.

• Elevates penalties under the minimum wage law from Class C infraction to Class B infraction, and from Class A infraction to Class C misdemeanor, when violations involve employees known to be illegal aliens or when the employer acts in reckless disregard of that status.

• Establishes that a federal immigration agency determination that an alien unlawfully entered or remained in the United States creates a rebuttable presumption of illegal immigration status.

• Adds definitions of "alien" (referencing 8 U.S.C. 1101(a)) and "federal immigration agency" to both the common construction wage law and minimum wage law chapters.

• Effective July 1, 2010.
