SB 213 Summary

• Department of Correction must evaluate citizenship and immigration status of committed offenders and notify U.S. Department of Homeland Security if unable to verify status or if offender is unlawfully present.

• State agencies and political subdivisions must use E-Verify program to verify work eligibility of newly hired employees and require contractors in public service contracts to do the same; contractors cannot knowingly employ unauthorized aliens.

• Sheriffs must make reasonable effort to determine citizenship or immigration status of persons charged with felonies or DUI confined in county jails and notify Department of Homeland Security if unable to verify.

• Makes it Class A misdemeanor to knowingly transport, move, conceal, harbor, or shield unauthorized aliens for commercial advantage or private financial gain; makes false identity statements a Class A misdemeanor.

• Prohibits governmental bodies from enacting policies that restrict sharing citizenship or immigration status information with federal authorities; allows private citizens to sue to compel compliance.
